To this day, the Lex Starzyński has been an integral part of the Austrian constitution. This article examines the originsof this provision on the distribution of competences, starting with the December Constitution of 1867, and followsits development up to the Federal Constitutional Law of 1920. It also focuses on the question of the extent towhich the reform proposed by Stanisław Starzyński actually changed the constitutional law of the day, and askswhether the term Lex Starzyński is justified.
