This article deals with the two essentials of the legal position of the Emperor of Austria: his irresponsibility and his inviolability. Irresponsibility meant that the em-peror could not be held accountable for his actions. It existed under absolutism and constitutionalism. In the constitutional system, however, it was supplemented by the system of ministerial responsibility. Inviolability meant that the emperor was specially protected by criminal law, above all by the offences of high treason and lèse majesté. Both were very far-reaching criminal offences.
